Username
Your username shall not contain a domain extension (.com, .net, etc.).
Store Names
If you create your own store, the store name shall not contain a domain extension, as stated above. Free stores will not place active or inactive links to a website that intends to divert users from Yabexe.com. Please restrict your advertising to inserts included with your shipment, or purchase banner space on our website. Paid stores only, may include a link to an offsite store.
Residency Requirements
Use of this website is for legal residents of the U.S. and Canada. ISP locations are checked and will be a determining factor of your location. If your ISP is found to be foreign your account will be terminated.
Use
This web-site is intended to be a friendly, enjoyable and useful experience, but as with anything concerning any kind of transactions there are risks involved and we strongly advise you to understand all of these terms before joining. If you spot a listing that you feel is violating the general terms and conditions of this web-site as stated below please let us know by contacting us.
Banned Items
You shall not list for sale or offer those items deemed by federal law to be illegal to possess, or transfer without legal authority. You shall not submit for offer alcohol, tobacco, drugs, pornographic images, including, but not limited to any other items not mentioned here, but nonetheless, may be illegal. Yabexe.com, its' owners and principles will not be held liable for such listings, may assist law enforcement if requested due to such listings, and may terminate the user upon notification of such listings, should we feel the listing was done in blatant defiance of our policy.

Shipping Charges
Unlike eBay we do follow a policy of not allowing outrageous shipping fees. However, the violation should be blatantly apparent. Listing an item for far below a reasonable "deal" and then adding shipping charges far in excess of what they should be will be looked at closely. For example, listing a new cell phone for a penny and charging $89 for shipping will be cause for administrative action.

However, having been sellers (and still are) we do take into account that the need for careful packing, including packaging materials and time involved may be considered into the shipping cost. The exceptions might be that the seller sends the item wrapped in newspaper and shipped in an old shoe box, but charges in excess of a couple of dollars above the actual shipping cost. Because of many variables, we do not rush to judgment and if you have a complaint we will handle them on a case by case basis.

One thing buyers can do is to carefully read and understand the shipping terms. While you may have a legitimate complaint about shipping costs, we suggest you do not bid on items that are blatantly apparent as being in excess of actual costs - no matter what the selling price starts at. If you agree to buy something "cheap" don't be shocked when you realize the sellers real method of profit has been through inflating the shipping costs.

Rights To Suspend or Terminate.
You agree that this web-site, in its own discretion, may terminate any auction or use of the service immediately and without notice if (a) We believe that you are not abiding by the general rules of this web-site (b) You have repeatedly broken a certain term (c) You have listed a suspicious item (d) We believe you to be a non paying bidder. (e) We believe you to be a non-delivering seller.
In most cases when we suspect foul play we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated.

Your Conduct.
You are solely responsible for the contents of your actions through this web-site. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation.
You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation.

Membership.
Membership to this web-site is only available to those you can form a legally binding contract. This web-site does not permit minors (under 18) to register. If any member is found to have signed up under our age requirement the account will be terminated immediately and and an administrative fee of up to $50 will be charged to any funds previously deposited.

As a result, we have no control over the quality, safety or legality of the items listed the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on.
In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretence.
This Web-site shall not be responsible for any items sold by Auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. This web-site shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained.
This web-site assumes no liability for the content of the listings.
However if you fall victim of a fraudulent transaction we will assist you as much as we can.

Credits.
Credits awarded, received, or obtained from Yabexe.com have no cash value for redemption or refund purposes. Credits are applied to any fees the user opts to use in their listing and may only be used on Yabexe.com.

Laws.
These Terms of Service shall be governed by and constructed in accordance with the laws of The United States of America and any disputes will be decided only by the Superior Courts of Carbon County, Pennsylvania, USA.
